论文摘要 2008年5月12日,四川汶川发生了里氏8.0级的特大地震,造成人员重大 伤亡。在灾难与搏击、新生与重建的艰难历程中,工伤保险工作作为抗震救灾工 作的重要组成部分,为保障职工的合法权益,确保灾区的社会稳定发挥了“减震 器”和“安全网”的作用,也实现了自身的新发展。 本文由汶川地震为切入口,分析地震灾害发生之后给工伤保险带来的各种影 响,从工伤认定、工伤待遇支付、工伤基金运行等各方面角度展开研究,为工伤 保险长远运行发展提供了有益的借鉴和参考。 全文分为六章。第一章简要介绍了选题背景,指出了研究的目的和意义,从 工伤保险的理论渊源、法律背景演变、工伤认定、工伤待遇及我国工伤保险发展 历程几方面总结了现有的研究成果;第二章结合地震中的实际措施分析了突发灾 害中不同人群能否认定工伤的缘由,这是本文开展研究的前提;第三章分析了地 震灾害对四川灾区工伤保险的影响及当地所采取的对策;第四章分析了参保与未 参保两大类人群的待遇差异;第五章着重构建了高危行业应对突发灾害的工伤补 充保障体系的具体框架;第六章结合全文分析,得出结论。 关键词:突发灾害;工伤保险;高危行业1 Abstract On May 12, 2008, Sichuan Wenchuan Earthquake measured at 8.0M and caused heavy casualties. Through this severe process of fighting for the disaster and newborn together with the reconstruction, Work Injury Insurance, as the important component of the relief work for fighting against earthquake and relieving disaster, plays a “shock absorber” and ”safety net” role in ensuring the social stability of the affected areas and further realizing new development of itself in order to protect the employer’s legitimate right and interests This paper as the entry point to analyze the aftermath of the earthquake brought to the Work Injury Insurance and to procure related research in terms of the injuries identification, payment of work injury treatment, operation of injury fund and additionally provide an useful reference and merits for long term operation and development of the Work Injury Insurance It could be found that there are six sections in this paper. The first section briefly introduces the topic background and the purpose and meaning of Work Injury Insurance, and moreover summarizes the existing research results in terms of the work injury identification, work injury treatment, the theory origin, the legal background evolvement and the development of Work Injury Insurance.
