导师意见：你好！论文我看了，选题很好。但是以下问题需要进一步完善：第一，最好写成问题导向型，通过具体案例引出问题，这方面的案件时是非常多的，在北大法宝和人民法院网和最高院案例汇编里面很多；第二，充分介绍最高院司法解释、批复等对挂靠的解决方法及存在的问题；第三，不能只是对挂靠成因的解释，而是在解释论上说明这些案件如何解决，挂靠有哪些类型，和分包、转委托、复代理等问题有哪些差别。总之，一定要对挂靠的类型进行分析，并最终结合案例提出自己的解决方法。参考文献还是太少了。祝好！ 建设工程挂靠问题研究 内容摘要 随着我国经济的快速发展，建筑业的发展已经成为拉动国民经济增长的重要力量。建筑行业的市场竞争不断加剧，建筑企业在建设施工等各环节所涉及的法律风险问题也日益增多。在建筑施工各领域中所暴露出来的“挂靠”、“转包”、“违法分包”等现象，严重破坏了我国建筑市场的正常秩序。虽然我国《建筑法》、《合同法》及《建设工程质量管理条例》等法律法规对于建设工程中的挂靠问题都有相应的规制，但是在具体实践中却成效欠佳。在诉讼案件中，讼争的当事人、律师、法官等对于挂靠的概念也存在不同认识和理解，往往导致案件处理结果大相径庭。笔者在本文中通过对建筑市场较为常见的挂靠类型入手，分析现行立法对于挂靠行为规制的不足，并提出相应的立法完善措施及可行性建议。 关键词：建设工程；挂靠；资质；规制 Abstract With the rapid development of our economy, the development of the construction industry has become an important force driving the growth of the national economy. The construction industry market competition unceasingly intensifies, the legal risks of construction enterprises involved in all links of construction are increasing.
