Law Civil litigation system deficiencies and improvement of agency by entrustment Candidate: Shi Lei Supervisor: Associate Prof. Tao Jian guo Specialty : Procedural law Academic Degree Applied for : Master of Law University : Hebei University Date of oral examination : June , 2013 摘 摘  要 要  民事诉讼委托代理制度，作为我国民事诉讼的一项重要法律制度，意在维护当事人 在民事审判过程中的合法权益，保障民事诉讼程序的顺利进行。然而，随着市场经济的 发展，我国民事诉讼所涉及的法律问题越来越复杂，传统民事诉讼委托代理制度已经出 现了诸多不足，逐渐走上与其立法精神相悖的道路，因此完善我国民事诉讼委托代理制 度势在必行。 2012 年 8 月 31 日，关于修改民事诉讼法的决定正式通过，其总结了市场经济体制 下民事诉讼委托代理工作的经验和教训，为民事诉讼委托代理制度进一步完善和发展奠 定了坚实的基础。综合看来，这些修改体现了国家对于提高民事诉讼委托代理质量的殷 殷期待，如何为我国打造一支业务素质高、群众反响好的诉讼委托代理队伍是本文研究 的重点内容。凡事过犹不及，具体来说：既不能“一棒子打死”公民诉讼代理，又要限 制职业公民诉讼代理的发展，既要鼓励律师在民事诉讼代理中承担更多责任，又要规范 其相关的诉讼职能和诉讼行为。 本文通过对我国民事诉讼委托代理制度立法及运行现状的考察，在民事诉讼法学专 家、学者以及民事诉讼委托代理实际工作者的有关论述和主要观点的基础之上，结合 2012 年民事诉讼法关于委托代理部分的修改，提出了自己关于完善我国民事诉讼委托代 理制度的一些建议。  关键词  民事诉讼  委托代理  公民代理  律师 Abstract Abstract Civil litigation entrusted agency system, as an important legal system of civil litigation in our country, to safeguard the lawful rights and interests in the process of civil trial, the parties guarantee the smooth implementation of the civil procedure. However, with the development of market economy, our country civil action legal question involved more and more complex, traditional civil litigation entrusted agency system has many deficiencies, gradually took to the road runs counter to its legislative spirit, thus consummates our country civil litigation principal-agent system is imperative. On August 31, 2012, on amending the civil procedure law decision formally adopted, it summed up the market economy under the system of civil litigation entrusted agency working experiences and lessons, to further perfect system of civil litigation entrusted agency and development laid a solid foundation. Comprehensive view, these changes reflect the country to improve the quality of civil litigation entrusted ag
