我国建筑业低碳化发展法律促进机制的研究.doc

 内容摘要 建筑业低碳化发展是一种低能耗、低污染、低排放、高效率、高效益的可持续发展 模式；是一场着重于建筑模式、生活方式和价值观念转变的建筑革命。建筑设计对碳排 放存在着决定性影响，建筑规划与设计无视碳排放控制造成了建筑设计阶段的高碳排 放，追求低成本的利益驱动又阻碍了节能设计方案的选用。建筑施工阶段建材使用不合 理、建筑保温效果差及建筑物节能检测方法的不科学，使得建筑高碳排放变为了现实。 再加上建筑运营维护阶段建筑节能改造成本分摊机制及低碳产品目录管理制度的缺失， 又使得公众建筑节能积极性不高。以上原因造成了我国建筑业高碳排放现状。 依法促进我国建筑业低碳化发展具有缓解资源对我国经济发展约束与促进我国内 需发展的经济效益、具有应对气候变化与改善环境的环境效益、具有为人类提供舒适生 活环境的社会效益。所以，依法促进我国建筑业低碳化发展具有一定的必要性。 建构建筑业低碳化发展法律促进机制能够解决市场及政府失灵所产生的问题，我国 现有的法制基础、建筑业低碳化发展实践探索的持续开展及国外依法促进建筑业低碳化 发展的经验也为我国建构建筑业低碳化发展法律促进机制提供了现实依据。 推进供热计量改革、制定可再生能源应用技术推广政策及加大经济激励力度可提高 相关主体实施建筑节能的积极性。建立建筑业低碳化发展的信息收集、传递与发布机制 可夯实我国建筑业低碳化发展的基础，解决开发商与消费者之间信息不对称问题。绿色 建材产品目录的编制及低碳产品目录的制定、建筑业低碳化发展评价机制的建立能为我 国建筑业低碳化发展提供有效的保障。 关键词：建筑业；低碳经济；建筑节能；清洁生产；环境保护 1 Abstract Construction low carbon development is a kind of low energy consumption, low pollution, low emission, high efficiency, high benefit the sustainable development of the model; Is a focus on the building mode, life style and values change architectural revolution.
