谈自侦工作中“以事立案”的运用 一、“以事立案案”的法律依据 “以事立立案”是指人民检察院自侦部部门依照管辖范围，对发现的的涉嫌贪污、挪用公款、私分分国有资产和私分罚没财物等等犯罪事实，或者对报案、控控告、举报等材料，经过审查查和初查认为存在上述犯罪事事实，需要追究刑事责任，而而犯罪嫌疑人暂时尚未确定，，或具体承担罪责尚未确定的的情况，所依法作出的立案决决定。 刑事诉讼法第83条条以及第86条明确规定：““公安机关或者人民检察院发发现犯罪事实或者犯罪嫌疑人人，应当按照管辖范围，立案案侦查。”“人民法院、人民民检察院或者公安机关对于报报案、控告、举报和自首的材材料，应当按照管辖范围，进进行审查，认为有犯罪事实需需要追究刑事责任的时候，应应当立案。” 由此可见，对对于直接受理的自侦案件可以以“以事立案”，这是我国刑刑事诉讼立法精神的体现。 二、“以事立案”需要注意的的问题 1、把握初查与立案案的衔接点 2、转变变立案观念 3、慎用强制措施 industrialization, industrial characteristics, contribute to ecological environmental protection.
