摘要 长期以来，刑事附带民事诉讼是否允许被害人向被告人提出精神损害赔偿请求问题，在法学理论界存在较大的争议，现行法律体系中民事实体法规定了精神赔偿，而刑事诉讼法又否定了精神赔偿。司法实践中存在民事实体法与刑事程序法的矛盾，适用出现不平等，不利于当事人在诉讼活动中得到公平的待遇，损害了司法公正，也有违立法的初衷。因此，笔者认为应当确立刑事附带民事诉讼精神损害赔偿制度。从我国刑事附带民事诉讼精神损害赔偿制度的现状出发，分析了立法规定、司法实践中存在的冲突和弊端，合理借鉴英美法和大陆法两大法系的相关法律，进一步探讨了阻却我国刑事附带民事诉讼精神损害赔偿确立的现行法律观点，并提出了确立我国刑事附带民事诉讼精神损害赔偿制度的法律依据。刑事诉讼 附带民事诉讼 精神损害赔偿 Abstract Since long ago, whether does the criminal supplementary civil action allow the victim to the accused person to propose the spirit damage compensate request question, in a legal science theory existence greater dispute, in the present legal framework the civil substantive law has stipulated the spiritual compensation, but Law of Criminal Procedure also denied the spiritual compensation.
