Unit 24 Jury (I) Jury System Jury system, the safeguard of individual and the method of people’s direct participation in judicial actions, is one of the oldest judiciary ways in the world. Its foundation goes back a thousand years to the French empire of the Carolingian kings, who developed a procedure called the inquest, or inquisition, to determine the nature and extent of royal right. American jury system Originated in England formally Developing on the base of American individualism culture Regarded as American democracy Its health is essential to continuing quest for equality and justice. Petit jury Petit jury is used in both civil and criminal cases. In civil cases ,its task is to determine liability to pay money damages; In criminal cases, its task is to determine whether the defendant is guilty or not . A jury in criminal case, composed of twelve people chosen at random in the widest population, examines the evidence ,discusses the details, and at last gives their own verdict according to their own understanding to the case. Petit jury It recruits a group of twelve laymen, chosen at random from the widest population; It convenes them for the purpose of the particular trial; It entrusts them with great official powers of decision; It permits them to carry on deliberations in secret and to report out their final judgment without giving reasons for it; The jury thus represents a deep commitment to the use of laymen in the administration of justice. Grand jury does not decide questions of guilt or innocence. Its function is accusatory. If the grand jury finds adequate evidences to warrant a trial, it will issue a true bill of indictment and the case will proceed. If the evidence is insufficient, the case will be dismissed.
