Policies and practices in China: Equal Consultation and Collective Agreement Background In accordance with the first ?Trade Union Law of the People’s Republic of China?in 1950, trade union organizations at the state-owned, collective-owned and private enterprises are entitled to represent the workers and staff members to sign collective agreement with the management. With China’s economic development and deepening of reforms, collective consultation and signing collective agreement have become a basic framework in which the coordinating of labor relations is conducted in the context of market economy in China. But it was until 1995 when the ?Labor Law?was implemented when it saw the official establishment of the system as a key gmechanism in adjusting the labor relations. And from then on, China has spared no effort in promoting and improving the system of collective contracts while building the socialist market economy. Firstly, the Chinese Government has attached great importance to equal consultation and the system of collective contracts. The Work Report at the 17th CPC National Congress indicates explicitly that percentage of per capita income in the distribution of the national wealth is to be further improved,as well as that of premiums of labor in the primary round of income distribution. It also indicates that income of the lower-level incomers should be increased through gradually upgrading the poverty line and local minimum wage standards, and by establishing a normal increase and payment guarantee mechanism of workers’ wages.
