我国的就业歧视及其治理途径

2011 年 月日目前我国的就业歧视现象日益凸现并受到社会的广泛关注,我国现有法律对于就业歧视的规定不够完善、缺乏可操作性,有必要制定专门的反就业歧视法予以完善。就业歧视社会问题我国日前反就业歧视立法尚不完善,理论研究也不够充分,本文在对就业歧视概念界定的基础上,探讨中国目前的就业歧视法律制度存在的不足,提出完善就业歧视法律制度的建议。

efficiently deal with discrimination in employment is a worthy discussion and practical problems need to be resolved. At present, Chinas employment discrimination has become more apparent and widespread concern by the community, our existing legal requirements for employment discrimination is not perfect, the lack of operability, it is necessary to develop specific anti-employment discrimination laws to be perfect. This article focuses on the concepts of employment discrimination and content, discrimination in employment around the social problems caused by doing the appropriate analysis. Chinas recent anti-employment discrimination is not perfect, theoretical research is not sufficient, the paper defines the concept of discrimination in employment on the basis of employment discrimination in Chinas current shortcomings of the legal system, made a personal employment discrimination on the sound legal system recommendations. This paper studies the use of standardized methods of case studies. Paper is divided into four parts: the first discusses the concept of employment discrimination and its manifestations and differential treatment in the market economy is equivalent to discrimination in employment; followed from the perspective of economic law on employment discrimination embodied in the failure of market regulation and the dilemma of government control defects were analyzed, and how to use the Law of the settlement mechanism to solve the problem of employment discrimination are analyzed; Finally, the practice of the U.S. anti-discrimination law, obtained a number of anti-discrimination legis
