浅析我国未成年人犯罪的现状及预防措施 广饶县人民检察院 曲小卫 摘要 未成年人犯罪已成为当今社会犯罪中一个越来越突出的社会问题，加强对未成年人犯罪的研究是世界各国刑事研究中的重要一环。未成年人身心发展的特点，决定了未成年人的犯罪具有可改造性和可塑性。因此对犯罪的未成年人要采用教育、感化、挽救的方针和坚持教育为主，惩罚为辅的原则，从而区别成年人犯罪。为了更好减少和预防未成年人犯罪，本文首先分析了未成年人的范围；其次，在分析了当前未成年人犯罪的特征和导致未成年人犯罪的原因，并结合实际情况的基础上提出了预防未成年人犯罪的措施，以期对未成年人的健康成长提供有益的帮助，从而从根本上达到预防未成年人犯罪的目的。同时本文也指出了我国在未成年人保护方面的许多不足，并从立法上提出了修改建议，且强调了加强未成年人犯罪国际合作的重要性，从而达到全世界共防的目的。 关键词：未成年人 未成年人犯罪 犯罪心理 预防措施 Abstract The minor crime has become now a more and more prominent social question in the social crime, the minor crime research is an important link of the various countries criminal activity research .The minor body and mind development characteristic has decided that the minor crime has the burst characteristics and the plasticity. Therefore it should use the education the influence the retrieval policy and the insistence education to the crime minor primarily and punish for the auxiliary principle, thus distinguishes the adult crime. In order to better reduce and prevent the minor crime, this article has analyzed the current minor crime characteristic and caused the minor crime the reason, and unified the actual situation in the foundation to propose preventing the countermeasure in the minor crime, provided the beneficial help by the time to minors health growth, thus reached higher authorities from the basis to prevent the minor crime the goal. Simultaneously this article has also pointed out our country protected the aspect in the minor many insufficiencies, and proposed from the legislation the revision suggestion, also emphasized that strengthens the minor crime international cooperation the importance, thus achieved the world altogether guards against goal.
