论我国行政相对人权利及救济 摘要：传统的行政法学注重从行政主体的角度探讨行政法问题，而忽视对行政相对人的研究，尤其是行政相对人权利的问题更没有得到系统阐述。虽然我国法律法规中承认了行政相对人的权利和保护，但是我国对行政相对人权利的重视还是不够的，而且行政相对人权利长期以来是行政法学研究中一个不被重视的课题，但是在倡导法治，推荐以人为本的今天，对行政相对人权利的保护则引起格外注意。因此，对行政相对人权利的深入研究也势在必行。本文对行政相对人权利的概念、内容及救济等方面进行了分析，希望形成一个系统的框架，以期待行政相对人权利的范围更加广泛，得到真正的保护，在面对行政侵权时可以有法可依，有据可依，为权益而斗争。 关键词：行政相对人权利 现状 保护和救济 Analysis of The relative Rights of the Executive and Relief Abstract：The traditional focus on administrative law from the administrative point of view to explore the main issues of administrative law, and the relative neglect of administrative studies. Key words：The relative rights of the Chief； Current situation； Protection and relief 引言 改革开放30年来，我国的行政立法从总体上看越来越重视行政相对人的权利，也越来越关注行政相对人权利的保护和救济，贯彻现代法的精神和价值。但也应清楚地看到目前的行政立法，行政执法等过程中不同程度地存在着忽视行政相对人权利的现象，同时对行政相对人权利的保护做得也不够。在构建社会主义和谐社会的大背景下，我们有必要对行政相对人权利做一个多方面的探讨。因此，本文会从以下几个方面来探讨行政相对人权利： 一、我国行政相对人权利概念及特点 目前，在我国，面对强大的行政权，行政相对人所拥有的微弱权利实在难以与之抗衡，虽有法律法规的规定，但仍不够全面，而且，行政相对人权利保护的失衡在行政权行使实践中是存在的 ,它给行政相对人应当享有的法定权
