我国信访法治化的路径研究 　　摘要： 　　信访的本质是公民维权与化解纠纷机制，如今信访却越来越面临着困境，不仅不能解决社会矛盾，反而加剧了矛盾；更日益与司法权威相冲突，成为建设法治社会的阻碍。信访作为“本土资源”有继续存在的必要，也有着政治与法律的渊源，但急需被纳入法治轨道。我国信访法治化的总体目标是构建科学的纠纷解决机制与公民权利救济机制，以保障公民参与政治的权利。信访法治化的具体改革思路为：明确制度定位并制定《信访法》；加强普法教育；建立诉访分离制度并树立信访制度的权威；要与人大制度紧密结合。 　　关键词：信访法治化；权利救济；司法改革；普法教育；诉访分离 　　[JP3]中图分类号：D616；D9221文献标志码：A文章编号：1671-1254（2015）03-0025-07[JP] 　　The Route Research on the Legalization of LettersandVisits Appeal of China 　　YAN Yong，MA Anfeng 　　（Literature and Law Institute，Sichuan Agricultural University，Ya’an 625014，Sichuan，China） 　　Abstract：The nature of letters-and-visits appeal system is that of the citizens’ safeguarding rights and dispute resolving.Today，letters-and-visits appealing is facing urgent predicament，which cannot resolve the social conflicts，and on the contrary，has exacerbated the conflict.What’s even worse is that it begins to get increasingly conflicted with the judicial authority，becoming the obstacle to the construction of the rule of law. Being“local resources”，letters-and-visits appeal has its own reasons for existence with its rooted political and legal associations.But it is urgently needed to be incorporated into the legal system.The overall goal of legalization of letters-and-visits appeal is to construct a scientific dispute settlement mechanism and the citizen抯 right relief mechanism to protect the citizen抯 rights to participate in the political affairs.This paper puts forward the following reform measuresio：1） to locate a clear system and develop“The Act of Letters-and-Visits Appeal”；2） to strengthen legal education to the public；3） to establish a system in which petitions are discriminated from letters-and-visits appeal and to establish the authority of letters-and-visits appeal system；4） to work corporately with the People’s Congress system. 　　Keywords：legalization of letters-and-visits appeal；right relief；judicial reform；legal education；separation of petition and letters-and-visits appeal 　　[HJ2.2mm] 　　一、我国信访制度的演变历程
