摘要： 随着时代变迁，社会的发展，每种法律都会具有滞后、局限等缺陷，很难随时跟上现代社会发展的节奏，改革开放以来，我国生产力得以提高，经济快速成长，伴随而来的是各种经济矛盾、社会矛盾凸显，执法纠纷案件巨大化。公民宪法权力是法治精髓，目前中国行政诉讼及民事诉讼领域绝大部分在财富资产权与人身权救济两个领域。公民相互密切的政治权力与经济社会权力则不足够获得救济，而宪法文本中却有着大量关于我国经济管理原则与人民群众政治权力的要求，宪法所确定的群众的基本权力如受教育权等具体法令中没有规定，使公民宪法权利缺乏完整保护。本文以我国宪法文本规范为出发点，通过概念对比，实务中的实践以当前我国司法适用中的障碍，由此得出结论，要把宪法适用到司法实践中，完善我国违宪审查、建立完整的宪法实施监督体系是当前亟待解决的问题。关键字：宪法司法化 违宪审查 权力救济AbstractWith the changing times, the development of society, the law will each have a certain lag, limitations, can not be readily adapted to the rhythm of hit social development, Chinas rapid economic development, peoples awareness of their rights strengthened, accompanied by a variety of economic issues, social issues highlight the complexity of the legal dispute.
