论我国婚前财产协议.doc

摘 要 婚前财产协议并未在具体的法律条文中出现，在司法实践中存在着不同的观点。婚前财产协议在夫妻离婚的时候对个人财产和生活方式能够起到自我保护的作用。在司法实践中解决因协议效力引起的争议和纠纷，必须明确其生效要件。我国《婚姻法》并没有对婚前财产约定时需要满足哪些条件做出完整、明确的规定。 我国关于夫妻财产协议的立法存在着没有区分婚前财产协议与婚后财产约定，缺乏对婚前财产协议所应具备实质要件的规定，尚未解决婚前财产协议对外效力的相关问题，尚未对婚前财产协议是否可以变更或撤销、无效情形及其法律后果做出明确规定等问题。针对性的提出应通过解决概念区分、相关的时间实质要件对外效力关键词Abstract Prenuptial agreement in specific laws did not appear in the judicial practice, there are different views.
