论我国驰名商标的保护制度 学生姓名 张 泽 明 二O一一年五月三十日 摘 要 根据我国社会主义市场经济发展的需要，并为适应我国加入世界贸易组织的要求，2001年10月27日，第九届全国人民代表大会常务委员会第二十四次会议通过了《关于修改＜中华人民共和国商标法＞的决定，对原《商标法》进行了修改，并于2001年12月1日开始施行。这次修改，增加了保护驰名商标的内容，将对驰名商标的保护从部门规章的层次提升到国家法律、法规的层次。 驰名商标具有识别和财产两重作用，所以对驰名商标的保护非常重要也有别于普通的商标，由于，我国对驰名商标保护起步较晚，相关的法律法规保护制度还不是很完善，而我国目前正处在经济高速发展的时期，驰名商标的相关保护任务艰巨，各种新问题，新情况的出现成出不穷，我国虽已加大了对驰名商标的保护力度，但与驰名商标有密切联系的经济正在飞速发展，新的问题不断出现，须进一步加强对驰名商标的法律保护。 关键词 驰名商标 保护制度 反淡化制度 司法保护 Abstract According to our country socialist market economic development needs, and to adapt our accession to the world trade organization request October 27, 2001, the ninth National Peoples Congress standing committee passed the 24th meeting about revising the trademark law of the Peoples Republic of China decision for the original trademark law change, and in December 1, 2001.
