旅游格式合同存在的问题和完善措施 [摘要]：随着经济的不断发展，生活水平的提高，人们对于精神消费的要求也越来越高。在现代化社会，最为普及的精神消费之一，旅游性消费成为关注的焦点。旅游不但能刺激人们的消费，同时，通过旅游这种方式，也能促进各地区的人文的交流沟通，更重要的是它对于个人的自由发展具有很大的作用，满足了人们的精神需求。目前各地的旅游化趋势正呈现大幅的增长的态势。但在旅游消费的同时，却也不可避免的产生了一系列的旅游合同纠纷。由于旅游合同都是通过格式条款的方式订立的，基于格式条款的特殊性就必然产生了很多问题，而为了尽可能的减少旅游格式合同的纠纷，有必要对旅游格式合同中存在的问题进行分析和探讨，从而能够提出合理的解决对策加以完善，更大范围的保护旅游消费者的利益。 [关键字]：旅游；格式合同；法律规制 [Abstract]：With the continuous development of the economy and the improvement of living standards, people’s spiritual consumption is also growing. In modern society, one of the most popular spiritual consumption, tourism consumption, has become the focus of attention. Travelling does not only stimulate peoples consumption, but it can also promote the communication between persons. What’s more, it is playing an important role in the free development of the individual and in meeting the spiritual needs of the people. Travelling is showing a substantial growth trend around the areas. But while people travel around the world, a series of inevitable travel contract disputes has emerged. Travel contract is signed by a form of slandered terms, for this reason, it will inevitably produce a lot of problems. And in order to minimize the disputes of the travelling form contract, it is necessary to analyze the existing problems in the travelling form contract and discussion. Thus, it can be able to propose reasonable solutions and countermeasures to improve current situation, which can protect the interests of tourism consumers in a broader scale. [Key words]: Tourism; slandered form contract; Legal Regulation 一、旅游格式合同的概述 所谓格式合同就是指为了重复使用而预先拟定的合同，它并不要求合同当事人经过协商而拟定条款内容。而旅游格式合同则是在旅游消费的过程中，旅行社一方就旅游提供的服务、发生的费用以及旅游相关事项为内容事先拟定好，并经旅游消费者合意，双方之间成立的合同。之所以在旅游时订立格式化合同，也有其合理性： 1、内容相对全面 由于旅游是一种特殊的服务消费项目，作为专门从事这项服务行业的经营者即旅行社一方，对旅行过程中可能存在的问题当然十分熟悉，也能够在合同订立之时就预先提出最合理的解决措施。另外，就消费者的权利保护问题上，旅行社也必然会在一定程度上基于诚实信用原则，尽到最大义务保护其合法利益，在合同中就做出提示，让消费者能够预先知悉，从而避免发生不必要的损失。 节约交易的时间和成本 由于合同本身就具有预先性，在未确定合同另一方当事人之时，就已经根据消费者可能提出的旅行需要事先制定了合同，而不需要与另一方当事人再经历长时
