西安建筑科技大学 课程设计（论文） 题 目 陕西省非物质文化遗产保护的法律研究 学生姓名 黄丹妮 学 号 081120107 院（系） 文学院 专 业 法 学 指导教师 李红梅 时 间 2011 年 5 月 25 日  摘要 非物质文化遗产保护已逐渐成为现在文化传统保护方面的突出问题，众所周知陕西又是十三朝古都，遗留有丰富的历史文化资源，而如今非物质文化遗产的保护面临各种现实因素的阻碍，给保护工作带来层层阻碍，本文从目前的国家立法与陕西的地方立法开始，分析陕西省非物质文化遗产保护现状，并参考目前韩国、日本、法国、意大利四个国家在非物质文化遗产保护方面已经取得的丰富经验，综合考虑到中国非物质文化遗产的特殊性以及对非物质文化遗产保护的紧迫性，再根据陕西省的具体情况和非物质文化遗产的双重性质决定了非物质文化遗产体现的双重利益关系，即法律保护体系的构建应当兼顾和协调公法保护和私法保护的关系。我们应该重点从国内立法上采取措施，分析私法保护和公法保护的利弊，得出更要用行政法在行政保障，即政府要对保护工作提供财政、政策、方式等各种保障措施Abstract Intangible cultural heritage protection has gradually become the protection of the present cultural traditional prominent problems, known as shaanxi fourteen thous legacy is rich in history, cultural resources, and now intangible cultural heritage protection faced all kinds of practical factors, that, to the conservation work, this paper brings layer upon layer from the current hampering the national legislation and shaanxi province of shaanxi province, analysis local lawmaking began the protection of intangible cultural heritage present situation, and reference to Japan, South Korea, France, Italy, and four countries in intangible cultural heritage protection have been made of rich experience, comprehensive considering Chinese intangible cultural heritage and the particularity of non-material cultural heritage protection urgency, again according to the specific circumstances of shaanxi province and the intangible cultural heritage of the dual nature of intangible cultural heritage determines the dual interest relations, reflect that legal protection system construction consideration shall be given to the public law and private law and coordinating the relationship to protect protection.
