犯罪本质研究 摘要：犯罪本质问题是刑法理论中的核心问题。研究犯罪本质，对立法和司法有着不可忽视的意义。笔者认为，犯罪本质特征与犯罪本质是不同的：本质是内隐的，需要分析与理解才能把握；本质特征是外显的，是能够被本人们感知的性状和特点。本质特征是现象层面的本质。所以，把握犯罪本质特征是最终界定犯罪本质的基础，而理解犯罪的定义则是界定两者的共同基础。本文共分为三个部分。第一部分是犯罪的定义，本笔者提出了什么是犯罪，犯罪定义的意义，并从刑法学的角度对犯罪的几种不同的定义进行了归类与解释；第二部分是犯罪的本质特征，本部分首先阐述了我国目前对犯罪本质特征研究的几种不同的学说，然后提出自己的观点，并分别从几个方面加以论证；第三部分是犯罪的本质，本部分提出了犯罪本质是具有多样性的，并从层次上、因果上对犯罪本质进行充分分析与论证，最后提出了自己的观点，对犯罪的本质进行的新的表述。 关键字：犯罪本质特征；犯罪本质；应受刑罚惩罚性；主观恶性. Abstract：Nature is the core issue in criminal law theory of crime. The nature of crime, with the legislative and judicial significance can not be ignored. In my view, essential characteristics of crimes and offences are different in nature: Essential feature is the explicit, is that people can be aware of the traits and characteristics. Essential feature is the essence of the phenomenon of level. Therefore, grasp the essential characteristics of crimes is the ultimate basis for defining criminal essence, and understand the definition of crime is a common basis for defining both. This paper is divided into three parts.
