浅析婚姻家庭法的近代转型作者:邓钦予专业班级：2011090201 指导教师：李琳摘 要婚姻家庭自古以来便是一种社会历史上的现象，也是人类社会经过不断的发展到达一定阶段后才出现的社会形式。随之而产生的婚姻法更是与每个公民的生活都息息相关。各国的婚姻家庭法都在不停地发展和变化着，其中就产生了各种不同的婚姻家庭法的转型。由契约观念引领婚姻法的转型将会成会社会主流。本文主要争对近代的婚姻家庭法的转型作出了浅要的分析和比较探讨，分别从英美法系和大陆法系两个不同的法系入手，研究和探究了其代表性国家的婚姻家庭法的发展历程，从而总结出其各自的转型特点、表现、优势。在最后将婚姻法这一大块的国际范围内的法制总结后，提炼出适合当今婚姻法发展的先进模式和理念——以契约观念引领婚姻法发展，得出用契约观念引导婚姻法发展的结论。进而对我国的婚姻家庭法作出浅析和发展模式的展望，希望有助于我国婚姻立法的改革和现今愈发激化的婚姻家庭矛盾的缓解。关键词：婚姻家庭 婚姻法 婚姻法转型 契约观念The modern transition of marriage and family law’s analyseAbstract:Since ancient times, the phenomenon of marriage and family is a social history, but also to society in the form of development of human society after a certain stage.
