[摘要] 笔者认为医疗责任保险被证明是化解医疗职业风险的最佳方法。本文通过介绍我国目前医疗责任保险的研究和实施情况和国外实施医疗责任保险制度的基本情况，分析了我国实施该项制度所存在的问题和造成这些问题的原因。针对目前存在的问题，如承保力度不够，投保率低，积极性低，缺乏控制已经投保的医院的医生发生保险事故的手段问题，提出了可行的对策建议，如建立专门的法律、法规，加大宣传力度，培养专业人才，开发新产品，提高服务质量，聘请专业机构处理医疗纠纷，借鉴国外先进经验，以使得医疗责任保险能尽早在全国范围内有效推广。最后，对医疗责任险在我国的发展进行了展望，开拓了新的发展思路，提出了更高的要求，如建立政府、医疗机构、医务人员三方共同投保的医疗责任保险机制，增加医疗责任险险种，医疗机构、医务人员、患者共同参保抵御风险,引入个人风险储金，由保险公司和医务人员共同承担赔款。 [关键词] 医疗责任风险 医疗责任保险 医疗鉴定　逆选择 风险管理 [Abstract]Medical liability insurance had been proved to be the best method to dispose the medical professional risk. The thesis introduced our country’s research and practice situations and foreign situations about the insurance practice, analyzed the problems and the reason for causing them in running the systems of medical liability insurance in China. Aiming at the subsistent problems (for example, lack of the strength of accepting insurance, the low insurance rate and positivity, lack of the method to control the peril not to happen), the thesis put forward some countermeasure and advices(for example, to establish expert laws and regulations, to enhance the strength of exploitation, to cultivate professional expert, to exploit new production, to improve the quality of services, to retain professional institution to deal with the medical knottiness, to make use of the foreign advanced experience) to make Medical liability insurance popularize in China as soon as possible. Finally, I assumed the prospect of Medical liability insurance in China, exploit new ideas and put forward higher request (for example, to establish the mechanism in which the government, medical institution and medical staff take insurance together, to increase the kind of Medical liability insurance, to make medical institution, medical staff and patient take insurance to resist risk together, to establish the personal risk fund, to make insurer and medical staff pay the claim together).
