河南科技大学毕业论文题目论期待可能性姓名＿张祎＿＿院系＿＿法学院＿＿专业＿法学121班＿＿指导教师赵秀荣2016年 6月5日论期待可能性The theory of expected possibility摘要：期待可能性诞生于 1897 年德国的“癖马案”，被日本法学界继承和发展达到了一个新的高度。引入我国后，我国刑法学界对此也颇为重视。就当前而言，期待可能性理论遇到了发展的瓶颈。在起源地德国以及发展地日本，对期待可能性的研究热情都在衰减。而在我国，社会发展又迫切需要对期待可能性理论的关注，因此对期待可能性问题的研究仍十分必要。本文从期待可能性的渊源入手，首先介绍了期待可能性理论的起源、演变与发展；其次记述了期待可能性理论的价值内涵和判断标准；最后分析了期待可能性在我国刑法中使用的必然性以及在刑法、司法实践中的具体运用情况，并结合我国的具体实际情况提出了新时期下期待可能性理论的深入适用，希望期待可能性的理念能实现我们对于保障人权和惩罚犯罪的初衷。关键词：期待可能性；癖马案；阻却责任；必要性与可行性Abstract：Expected possibility was born in 1897 in Germany horse addiction, legal science inherits and develops by Japan reached a new height.
