我国国防专利解密制度的检讨与重构 我国国防专利解密制度的检讨与重构 1 摘 要: 我国“重必威体育官网网址，轻解密”的国防专利制度现状，阻碍了国防科技成果向民用市场转化为生产力的进程，损害了国防专利权人的利益。国防专利派生于普通专利制度，公开性是传统专利制度的首要特征，而必威体育官网网址性却为国防专利最显著的特征。因而，在把握国防专利的知识产权本质的基础上，准确认识必威体育官网网址的重要性及解密的必要性与及时性问题显得尤为重要。通过检讨我国现有国防专利制度的不足，建议细化现有国防专利解密制度，通过完善解密原则、解密年限、解密标准、解密程序以及建立健全配套制度来重构我国国防专利解密制度。 关键词: 国防专利；解密制度；制度重构 The Review and Reconstruction of The National Defense Patent Decryption System in China Yang Meilan1 (College of Humanities and Social Sciences, Nanjing University of Aeronautics and Astronautics, Nanjing 210016, China) Abstract: The status quo of our country’s national defense patent system is “Heavy secret, light decryption”, which hindered the process of national defense science and technology achievements transforming to the civilian market into productive ,and greatly harmed the interests of national defense patent holder. National defense patent is derived from ordinary patent system, openness are the primary characteristics of the traditional patent system, and the confidentiality is for national defense patent the most prominent feature. Therefore, to correctly understand the essence of intellectual property rights, to accurately recognize the importance of the confidentiality of the national defense patent,as well as the necessity and timeliness of the decrypt, which are particularly important. Using empirical analysis, comparative research, analyzing its disadvantages. Suggest that refining system of our countrys national defense patent decryption, through perfecting decryption principle, decrypt the fixed number of year, decryption standards, declassification procedures, and establishing and perfecting the supporting system to reconstruct the system of national defense patent decryption in our country.
