农村土地内部产权关系解构下的征地补偿标准研究

摘 要:研究意义:通过对农村土地内部产权关系进行解构,将承包经营权的权利构成分为承包权和经营权两部分,并分别界定农户和个人承包权和经营权的取得和灭失条件。通过分析现行征地的补偿机理,发现现行征地补偿政策存在承包权补偿无依据,经营权补偿无科学的确定方法等问题,进而为改进现行征地补偿政策提出意见和建议;研究方法:理论分析法,文献资料法;研究内容:征地造成农户及其成员本轮承包期内经营权的丧失,但并不必然造成农户及其成员下轮承包权的丧失。在承包期内,由于新增人口、死亡人口等情况的存在,户内的承包权和经营权状况也发生着动态的变化,各成员享有的承包权和经营权存在着一定的差异,而现行的征地补偿政策是以征收的土地为标准计算每个安置人口的安置补助费,并作为承包权和经营权的补偿,没有针对征地时涉及户内各成员享有的承包权和经营权情况做出相应的补偿,这种补偿方式存在着很大的弊端;研究结论:科学的征地补偿标准,要对因征地而造成权利人受损的各项权利充分的补偿,不仅要补偿本轮承包期的经营权,也要对未来承包土地的权利做出相应的补偿,本文提出了五种对下轮承包权的补偿方法,针对现金补偿下轮承包权的情况,又提出了收益还原法和年产值倍数法两种具体计算方式,对于经营权的补偿采用年产值倍数法,且补偿倍数与剩余承包年限相挂钩。

Study on Compensation Standard of Land Requisition Based on Deconstruction of Rural Land Property

Abstract: Research significance: Through the deconstruction of rural land property, the contracted management right will be divided into two parts: Contract right and management right, furthermore, the acquisition and loss of these two parts have been well defined. By analyzing the compensation mechanism of existing land requisition, it revealed that there are some common problems, which including unfounded compensation for contract right and management right without scientific method of determination etc in current compensation policy of land requisition, in this way, some suggestions are put forward for the improvement of current compensation policy of land requisition. Research method: method of theoretical analysis and means of documentary. Research contents: Land requisition leads to the loss of land management right of farmers and his family members in this round, but it is not necessarily influence their land management right in next round.
