Reviewing the origin of the punitive damages, its development and functional orientation, this paper analyzes of the ne- cessity and rationality of introducing the system of the punitive damages. In addition, it explicitly insures the punitive damages as the 96th article of / Food Safety Law0 . Moreover, according to the discussing about these problems by academic community, this paper indicates the criticism between the maneuverability, compensation and practical effect about the system of punitive damages. Focusing on these criticisms, several rational proposals are advanced in this paper.
