抽象人格演进的文化解释与民法典的整合和分解

摘 要 : 近代抽象人格制度得以确立 ,实有赖于宗教 、伦理 、经济和哲学等各种因素的推动 。抽象人格实现了近代民法典
的整合 ,并使得民法典的价值定位在个人自由之上 。现代市场机制使抽象人格的普遍性得以消解 ,人们逐渐被区
分为强、弱两种类型 。为了保护弱者 ,实现社会正义 ,作为抽象人格代表的民法典被分解的命运是不可避免的。

tors. Ab stract p ersonality has ach ieved the integration of the civil code, reflected individual freedom as the civil code val
ue. Modern m arket m echan ism m akes the un iversality of ab stract p ersonality to digestion , hum an being has been divided
into strong and weak typ es. In order to p rotect the weak , ach ieve social ju stice, as the rep resentative of ab stract p ersonal
ity, the fate of civil code decompo sition is inevitab le.
