法学毕业论文格式范文 法学论文范文格式 摘 要 司法效率一直是倍受法学界关注的话题。当前，我国民事纠纷诉讼增长迅速，给法院工作造成相当大的压力，给审判方式改革带来了种种难题。在提高司法效率，特别是在保障小额债权诉讼权利人利益方面，是进一步修改完善现有的简易程序，还是重新制定一种小额诉讼程序，以实现小额权利人简易快捷便民的程序利益，却是一个一直存有争议的问题。小额诉讼程序是一种简易快捷的诉讼程序。其建立不仅是基于对民事案件进行分流处理和减轻法院负担的一种构想，也在于通过简易化的努力使每个公民得到具体的有程序保障的司法服务。本文认为，基于我国实际，应选择重新制定一种小额诉讼程序的立法思路，因而，本文在对我国简易程序进行反思的基础上，探讨了设立小额诉讼程序所应依据的价值基础和初步的运作设想。 关键词 简易程序 小额程序 架构 China’s establishment of small claims procedures Abstract Judicial efficiency has been greatly concerned about the topic of jurisprudence. At present, China’s rapid growth in the civil lawsuit to the court caused considerable pressure to reform the way the trial has brought all sorts of problems. To improve judicial efficiency, especially in small claims litigation to protect the interests of rights holders, is to further revise and improve the existing summary procedure, or a small re-enact the proceedings in order to achieve the rights of small, simpler and quicker procedures for the interests of convenience, but there has been a controversial issue. Small claims procedure is a quick summary of the proceedings. Its not only in civil cases is based on the triage process and to reduce the burden on the court as a concept, it is the summary of the efforts to make every citizen of specific procedural safeguards of the judicial system. This article, based on the reality of our country, should be chosen to re-develop a small idea of the proceedings of the Legislative Council in order to achieve the purpose of the administration of justice closer to the people. This article in the summary to reflect on our country on the basis of the proposed the establishment of small claims procedure should be based on the value of the foundation and initial operation of the idea.
