摘 要 摘 要 本文充分使用文献调查的方法，在了解了小产权房的背景与研究意义的基础之上， 引用了《宪法》《物权法》《土地管理法》《房地产管理法》等相关法律以及国务办公 厅、国土资源部等部门颁布的一系列的政策性文件，总结了国内学者的相关研究成果， 并引入“李玉兰”案作为案例分析的对象，从信赖利益、合同有效性、《物权法》等法 律基本原则的角度分析了法院判决的合理与不合理的成分，以及结合小产权房现状思考 了问题产生的原因，并从纠纷解决、土地制度、社会保障制度等等角度提出了解决问题 的建议。最后，笔者得出了小产权房应当有限合法化的结论。在保护耕地不被流失的前 提下，完善土地流转制度，有条件地给予小产权房合法的地位，既是缓解当前房地产市 场房价虚高、供求矛盾的有效方法，也是保护和实现农民集体土地权益以及城市居民的 权益重大措施。 关键词 小产权房 政策 法律问题 合法化 I Abstract Abstract This method fully uses the literature survey, based on understanding the background and significance of the research of the housing of small property right of the above cited constitution, property law land management law real estate management law and other relevant laws and state office, the Ministry of land and resources and other departments promulgated a series of policies documents, summarizes the relevant research results of domestic scholars, the object and the introduction of Li Yulan case as a case study, the reliance interest, validity of the contract, property law and other laws and basic principles of the courts reasonable and unreasonable components, as well as the combination of the small property right room on the status of the causes of the problem from the point of view of, dispute settlement, land system, social security system, puts forward suggestions to solve the problem.
