摘 要 自20世纪90年代开始，新闻媒介开始更多地介入到司法审判程序之中，履行其新闻舆论监督职责，而1997年张金柱案更是引起广泛关注。但21世纪以来，“媒介审判现象”却更加频繁出现，并且逐渐偏离其初衷，阻碍了司法公正及正确司法意识的树立。因此，“媒介审判”现象也普遍受到了来自新闻传媒界、司法界学者的广泛关注。当前，关于“媒介审判”现象的研究中，以魏永征先生最为权威，其对“媒介审判”之定义被众多学者认同。另外，慕明春先生对“媒介审判”现象的机理、对策之研究也极具参考价值。但是，众多学者关于“媒介审判”现象的研究，更加偏向于其机制的研究，较少涉及对策，或所提出的对策不够全面。本论文将从背景概述、机理剖析和提出对策几个方面展开论述，并且最后将根据新闻界、司法界及公众等对象的不同，寻找控制、解决“媒介审判”现象问题的对策，以切实有效的解决“媒介审判”现象所带来的负面影响，为当下“媒介审判”现象的失控提供参考。 关键词：媒介审判；媒介责任；新闻监督；司法公正；对策 ABSTRACT Since the 1990s,the media began to get more involved in the judicial process to perform its duties of the news public opinon supervision,especially the case of Zhang Jinzhu in 1997 caused more attention.But in the 21st century,the media trial phenomenon appeared more frequently,and gradually deviated from its original purpose,hindering the judicial justice and the establishment of the right judicial consciousness.therefore,the media trial phenomena has also been wide attention of scholars from the news media and judiciary.Currently, for the media trial phenomenon,the research by Mr. Wei Yongzheng is the most authoritative,his definition for the media trial has been widely accepted by many scholars.And in addition,Mr. Mu Mingchuns research to the media trial phenomenon about mechanism and countermeasures also extremely has the reference value.However,many scholars researches to the media trial phenomenon more biased in the study of its mechanism,and less concerned coutermeasures or the proposed countermeasures are not enough comprehensive.This paper will overview from the several aspects like background, mechanism analysis and the countermeasures,and finally according to defferent objects such as the press,the judiciary and public to look for the countermeasures to control and solve the problem of the media trial phenomenon to practically and effectively solve the negative effects of the media trial phenomenon,and provide the reference about the media trial phenomenon runaway nowadays.
