我国医疗责任保险发展现状及分析.doc

内容摘要：近年来，随着人们法制意识的普及以及从业医师的多点执业化，我国医疗纠纷呈现出一种惊人的增长态势，医疗机构及其从业人员也因此面临着日益严峻的医疗责任风险以及不小的经济赔偿压力。而目前医疗纠纷案件的解决渠道并不能很好地满足医患双方的需求，医患纠纷案件所引发的群体性事件甚至已严重地制约了我国医疗卫生事业的健康发展，已经成为了影响社会长治久安的突出问题。医疗责任保险从一定程度上，可以分散医疗机构及其员工的执业风险，维护医疗秩序，缓解医患间矛盾，已引起社会各界的共同关注。笔者分析了该险种在我国发展滞后的个中原因，提出了包括完善有关法律法规等在内的四点建议与设想，以完善我国现行的医疗责任保险制度。 关键词：医疗责任保险 调解 医疗纠纷 Abstract:In resent years, with the popularization of people’s legal awareness and multisite practice of physicians, medical deputes in our country has shown a starling trend of growth. Medical institutions and doctors are also facing growing medical liability risks as well as the stress of economic compensations.However, current channels for resolving medical disputes can’t meet the needs of the doctors and patients well.The riots caused by the physician-patient disputes have constrained the healthy development of medical and health service seriously and become an extrusive problem which has severe impacts on social stability. To a certain extent, medical liability insurance that can diversify the risks of medical institutions and their employees, maintain the medical order and ease contradictions between doctors and patients has drawn the attention of both the medical profession and the legal profession. After analyzing the related reasons and problems,this paper argues that if we want to perfect medical liability insurance system in China,we should take some effective measures including improving related laws and regulations.
