2008年1月 首 都 体 育 学 院 学 报 January．2008 第 2O卷 第 1期 Journal of Capital Institute of Physical Education Vo1．2O No．1 体育纠纷ADR的程序机制探析 An Analysis of the Procedural Mechanism of ADR in Sports Dispute 刘 苏 LIU Su 摘 要：体育运动的日益商业化和社会化导致体育争端越来越多。目前，国际上越来越 多的国家采用替代性的纠纷解决方式裁决体育争议。而我国至今仍没建立自己的体育 纠纷解决机构，没有一套完整的快速解决体育纠纷的机制。我国体育纠纷解决机制的 单一性、体育仲裁机构的缺失、体育组织自治模式的不健全等现状更说明了体育纠纷 ADR的程序机制研究的现实迫切性。而我国的传统文化为其构建提供了必要性和可 行性。借鉴民商法ADR机制的运作积累、依据我国相关的法律规定，在兼顾体育纠纷 特殊性的基础上本文构建出了一套包含体育调解、体育仲裁、体育谈判(体育和解)、体 育组织内部裁决在内的体育纠纷ADR协调契舍程序机制。 关键词：体育纠纷ADR；体育谈判；体育调解；体育仲裁；体育组织内部裁决 中图分类号：G8O—O5 文章编号：1009—783X(2008)O1—0028—07 文献标识码：A Abstract：The ever increased commercialization and socialization of sports activities have led to more and more sports disputes．Today，many countries in the world have adopted some kind of substitutive methods to solve and judge sports disputes．In China，however， there are still not any established organizations for solving sports disputes and there is not any complete mechanism to be used to deal with sports disputes quickly．Currently， the unitary mechanism for sports disputes，the lacking of sports arbitration agencies and the incomplete mode of autonomy in sports organizations demonstrate more clearly the realistic urgency of the research of the procedural mechanism of ADR for sports dis— putes．Drawing lessons from the operation of ADR mechanism in civil commercial law， considering the special characteristics of sports dispute．in accordance with relative legal regulations in China，the authors have constructed a set of coordinative ADR procedural mechanism for the
