未成年人前科消灭制度的立法研究 【摘要】　近年来，随着未成年犯罪记录封存制度的确立，关于未成年犯罪前科消灭制度的研究成为法律界的潮流，但未成年犯罪记录封存根本不同于犯罪前科消灭，本文从未成年犯罪前科消灭的刑理价值出发，通过对比国外的未成年犯罪前科消灭制度，在界清未成年犯罪前科消灭制度与未成年轻罪犯罪记录封存制度的区别后，在未成年犯罪记录封存的基础上确立未成年犯罪前科消灭制度的模式，做好前科消灭与刑法累犯再犯规定 【关键词】　未成年前科制度　　未成年前科消灭制度 未成年犯罪记录封存制度 The legislative studies of the Minor Criminal record system Abstract　On March 14, 2012, the fifth meeting of the 11th National Peoples Congress for the second amended criminal procedure law establishes a minor misdemeanor criminal record storage system. on May 2012, the supreme peoples court, the supreme peoples procuratorate jointly the ministry of public security, state security and the ministry of justice issued a notice about the opinions of the build system of crime personnel records, which starting the establishe of The minor criminal record storage system. Combined with Chinas laws and regulations, the judicial organization structure and the status quo.
