毕 业 设 计 论 文 论暗访的合法性及其道德底线 院 系： 专 业： 学生姓名： 指导教师： 摘 要 暗访是新闻记者为了获得事实真相，隐瞒自己身份，采用秘密的合法手段获取新闻材料的调查方式。它是一种非常规的采访方式和特殊调查手段。暗访自1890年产生以来，就一直受到法律界与社会的质疑。那么暗访到底是合法还是非法？暗访的合法性，要具体情况具体分析，暗访作为新闻调查手段的一种补充，是媒体新闻调查、监督政府和社会、获得事实真相的一种必要而有效的手段。但这并不意味着暗访可以随便运用到任何新闻调查中，甚至是滥用暗访。新闻媒体工作者在使用暗访的过程中要遵循法律，使用合合法的暗访手段去获取新闻材料，不到必要时刻不要运用暗访手段，更要秉持道德底线，具有社会人文关怀精神，注意保护老人、儿童等弱势群体。贺卫方教授曾将暗访比作“毒树之果”，是不能吃的，随着法制体系的不断健全，暗访手段将会越来越少用到，但这是个漫长的过程，存此之前，暗访的合法使用更多的是要依靠新闻界的自治。 关键词：暗访 合法性 道德底线 Abstract Investigations are journalists order to get the facts, conceal their identity, the secret legal means for the news materials research method.
