浅析见义勇为立法 —保障见义勇为行为 [摘要]“见义勇为”这一古老的命题因近年不断发生的见义勇为赔偿案和见义不为的行为日益普遍，引起学术界的热烈探讨，促使许多学者都在寻求解决方案，但都没有达成统一的观点。本文提倡对见义勇为进行国家性的专门立法来保障见义勇为行为，通过从道德、法律上阐述见义勇为的概念，并分析了见义勇为行为的性质及其构成要件，提出具体立法内容和立法应保持一定的限度。再结合对见义勇为保障现状的分析，阐明见义不为的原因，提出民法的保障、刑法的保障、劳动法的保障等并不能起到必要的保障作用，加上地方立法的杂乱、无绪，更加说明见义勇为立法的必要性。 [关键词] 见义勇为；立法；行为；保障 The Brief Analysis Behaves Righteously Legislates The safeguard behaves righteously behavior Abstract: In recent rears, the compensation of behaves righteously is often occur .It is common that don’t to help people in danger,so causes academic circles warm discussion, urged many scholars to seek the solution, but has not reached the unified viewpoint.This article advocated that to behaves righteously carries on the country legislation to safeguard specially behaves righteously the behavior, through from the morals, the law elaborated behaves righteously the concept, and analyzed has behaved righteously the behavior nature and the constitution important document, proposed that the concrete legislative content and the legislation should maintain certain limits. Again The recombination to behaves righteously the safeguard present situation analysis, expounded sees righteousness not for the reason, proposed the civil law safeguard, the criminal law safeguard, the labor law safeguard and so on cannot play the essential safeguard role, in addition the local legislation disorderly, even more explained that behaves righteously the legislative necessity.
