浅析我国的工伤赔偿制度 摘 要 随着工业化的发展，机械化操作使劳动者在生产过程中危险因素增大，伤残事故和职业病大量增加，工伤赔偿案件成为劳动争议中大量发生的案件。人们在享受生产力飞速发展所带来的物质文明的同时，也在承受着与日俱增的工伤事故所带来的痛苦和损害。如果不能在经济和物质上为工伤职工提供相应的保障，不仅影响在职员工的生产积极性，也会影响社会安定，工伤问题进而成为社会问题。因此各国为保障职工权益，大都建立了工伤赔偿制度，以适应社会的需求。针对工伤问题的理论研究也日益兴起，在研究过程中，学者观点不一，存在很大争议。目前我国关于工伤损害赔偿方面的法律法规还不很完善，司法实践中对工伤案件的处理也存在混乱和争议。本文从构建和完善我国工伤赔偿制度的角度出发，先讨论工伤赔偿的概念和性质等基本理论问题，接着从工伤赔偿责任的归责原则入手，系统分析工伤赔偿责任的构成要件，进而立足我国现行立法，分析我国工伤事故认定的机构和程序及赔偿范围，并针对我国现行立法，分析立法和实践中存在的问题，为完善我国工伤赔偿制度提出几点建议。 关键词 工伤，工伤赔偿，工伤赔偿责任，工伤赔偿制度 ABSTRACT As the industialization develops, the mechanized operation increases dangers for labours to produce.And it causes a large number of wounded and disabled as well as occupational diseases. Moreover, the compensation of injury on job becomes a case usually happens amony the work dispute. While people are enjoying the material civilization which is brought by the development of capacity at full speed, they are buring the pains and losses made by the injury on job. If corresponding safeguards on economy and material are not offered to the injured employees, it will not only influence the incumbents, enthusiasm for producing, but it will also coffect the social stability. The problem of injury on job will then become a social problem. So most countries, in order to protect their workers, rights, have established the system of injury on job compensation to adjust the needs of the society. As to the study of the injury also springing up, scholars have different ideas, and there are great disputes during the process of the study. Now, the laws and regulations about the injury on job compensafion in our country are still not perfect. There are also disorders and disputes when the injury cases are handled in the judicial practices. This article, based on the view of setting up and perfecting our sustem of injury on job compensation, firstly discusses some foundamental problems,such as the conception and quality of the injury on job compensation.
