摘 要
在早先的工程建设领域中,市场竞争机制不健全,资源配置不合理,市场中的交易行为不规范、不正当等问题频频出现。为此,我国自20世纪80年代开始,逐步在全国的工程建设领域范围内推行招投标制度。这一制度推行后,以上问题得到一定程度的改善。然而,在实施过程中,仍有许多问题亟待解决。从我国目前的建筑市场来看,工程招投标过程中存在施工队伍素质不高导致工作质量低下,腐败现象严重导致资金流到工程以外等问题,而实行“无标底”招标可建立公平的竞争环境,真正让市场、让法律、合同发挥作用,使权力、关系在招标中的作用丧失,对整顿规范建筑市场有治本的意义。实行“无标底”招标,可通过激烈的市场竞争寻求到技术及管理水平高的承包商,他们的个别成本低于社会平均成本,从而节约工程造价。另一方面,由业主提供实物工程量清单,施工单位根据自身情况及市场行情自主报价,可避免多家投标单位重复计算工程量,减少人力、物力及财力的浪费,并可减少标底编制及评标成本,从而提高社会效益。 During the previous engineering construction field, some problems such as market competition mechanism isn’t perfect, resource allocation isn’t reasonable and transaction behaviors aren’t standard or justified in the market occurred frequently. For this, our country gradually implements the system of bidding in the scope of national engineering construction field since the 1980s. After implementation, the above problems are solved to a certain extent. However, in the process of implementation, there are still many problems needing to be solved. For example,in the current construction market view,there exists some issues such as low quality of the construction team leading to low quality of work, serious corruption leading to capital flows out of the project during the process of construction bidding.A fair competition environment could be built, market 、law and contracts could be functioned and the effectiveness of power and relationship could be lost, taking out the non-price bottom bidding has a permanent significance of rectifying and regulating the construction marker.This article aims at analyzing risks the owner may take the under non-price bottom bidding mode and giving related suggestions.
