诉讼中作被告。行政复议委员会之内部组织体制，则应当遵循机构、编制和人员与职能任务相适应的行政组织原理，基于其立案、调查、审议和议决等职能任务来设置机构、确定职位和编制、选定人员并规范其管理，科学设计行政复议委员会的内部工作程序以促进办案公开、独立和专业，保障外部复议委员的有效实质参与。关键词：行政复议；复议公信力；复议主体；复议委员会AbstractAdministrativereviewsystemisonlythealternativeapplicationwayinthecurrentlegaladministrativedisputeresolutionsystems.Publiccredibilityisnodoubtthelegitimatebasisforthepresenceoftheadministrativereviewsystemandisitsvitalityfordevelopment.However,inthedomesticacademiasofar,notenoughattentionhasbeenpaidtopubliccredibilityoftheadministrativereviewsystem.Ontheotherhand,inordertooptimizethefunctionsoftheadministrativereviewsystem,aseriesofjustice-orientedandprocedural-focusedreformingmeasureshavebeencarriedoutinrecentyears,buttheeffectisminimal,thereasonofwhichcanbesafelyattributedtotheabsenceofreformintheadministrativereviewsubjectsystem.Researchesonthereformoftheadministrativereviewsubjectsystemareprosperousinthecurrentdomesticacademia,engenderingmixedviews,butowingtothelackofpubliccredibilityplayingaguidingrole,thebasicconsensushasyettobereached.So,itisnecessarytotakepubliccredibilityoftheadministrativereviewsystemasthestartingpointaswellastheendinthereformoftheadministrativereviewsystem,andwhichshouldfocusonthereformoftheadministrativereviewsubjectsystem.Publiccredibilityoftheadministrativereviewisacombinationofvariousabilitiessuchasjudgment,acceptance,binding,autonomyandself-control,whichevolvefromatrustforpubliccreditpresentedinthepowerofadministrativereviewduringtheprocessofinstitutionalizedconstructionandoperation.Thosefiveabilitieshavetheirownrespectivegenerativemechanisms.Administrativereviewjudgmentcomesfromreviewpersonnel’sabilitytounderstandandapplytherulesofevidence,legalapplicationandmeasurementofadministrativereasonableness.Administrativereviewacceptanceoriginatesfromaseriesoflegitimatemechanismsofadministrativereviewprocess,includingopeningprocedureandacceptingapplicants’participation,permittingapplicants’rightsoffullyexpressingtheirviewsandgivingnecessaryresponses.Inform,administrat
