摘要2013 年我国出台了人们期盼多年的《旅游法》。旅游合同结束了长达 30 多年无名合同的历史。弥补由于我国旅游合同私法规制真空地带带来的不足。但《旅游法》中对精神损害赔偿是否可以作为一种违约责任的救济方式,精神损害赔偿的条件如何,赔偿精神损害的标准怎样确定。并对旅游消费者在合同签订的过程中频繁出现格式条款现象进行分析,总结出了旅游合同中出现格式条款现象的原因,并提出了针对性的措施。本文首先对旅游合同的概念和特点进行了论述，接着就旅游合同的类型和法律性质进行了阐述；其次介绍了域外的旅游合同立法情况并作了相应评析；再次分析了我国旅游合同立法的现状并剖析了当前存在的主要问题；本文结合《旅游法》的相关规定对纠纷的实质和解决进行分析。有纠纷往往就会涉及到赔偿，而对于旅行社损害赔偿的研究，我国的旅游基本法并不如国外法律规定健全，虽然关于惩罚性的损害赔偿制度是本次旅游法的一大亮点，但精神损害赔偿与时间损害赔偿我国法律并未规定，通过对域外相关制度的分析和比较，本文为我国旅游法进一步完善提出了建议和构想。关键词：旅游合同；纠纷；损害赔偿；优化ABSTRACTIn 2013, China promulgated the law of tourism people looking forward to many years of .
