AbstractThispaperisdividedintofourparts.Thefirstpartdefinesandexplainsoftheconceptofrealestatebrokeragecontract.Realestatebrokerrealestatebrokeragecontractisacontractwhichenteredintobyrealestatebrokerageagencyandclient,whichtherealestatebrokerageagencyprovidesservicesuchasthereportingofenteringintoacontract,agenthousetransfer,mortgageandutilitiestransfer,theclientpaystheremunerationtotherealestatebrokerageagency.Realestatebrokeragecontractisacontractwhichrealestatebrokerageagentdealwithissuesrelatedinthenameoftheclients.Itisanonerouscontractinwhichrealestatebrokersprovideservicesandtheclientpaystheprice.Anditisalsoabilateralcontract.Meanwhile,realestatebrokeragecontractisnotawrittencontractingeneral.Thesecondpartistheanalysisofthelegalnatureoftherealestatebrokeragecontract.Realestatebrokeragecontractisestablishedbetweenequalentities,aimtoestablish,vary,andeliminatetherelationshipofcivilrightsanddutieswhichhasthenatureofacivilcontract.Accordingtoacontrastbetweentherealestatebrokeragecontractandintermediary,delegationcontracts,theauthorfindsthatthereexistsomesimilaritiesamongthem.Buttheintermediarycontractandthedelegationcontractcannotfullycoverallthefeatureofrealestatebrokeragecontract.ThroughtheinvestigationofrealestatebrokeragecontractinBeijing,Tianjin,Chongqingandotherplacesandtransitionphases,theauthorfindsthatrealestatebrokerageincludesbothintermediateandcommissionedlegalrelationships.Furtherclarifyingofthecontractsimultaneousandhybridcontractgivestheconclusionthatthelegalnatureoftherealestatebrokeragecontractisacombinationofthenatureofintermediaryandcommissioncontract.Thethirdpartisthelegalapplicationofrealestatebrokeragecontract.Duetotheconfusionsinidentifyingthelegalnatureoftherealestatebrokeragecontract,therearemanyproblemsinitsapplicationoflaw.Astherealestatebrokeragecontractbelongstothetypeassociationcontract,therefore,theeonflietoflawofrealestatebrokeragecontractistoprimarilydecomposethehybridcontract,applystipulationsofdifferenttypicalcontractstodetermin
