AbstractProtection of personal information is coming with the advent of the information age. The arrival of the information age is like a double edged sword, leading the development of human society, but it may also pose a threat to individual rights and human life. Fingerprint is the shape of lines objectively existed in the finger, with a permanent and unique feature, often used as a precise tool to identify an individual. It also often occurs simultaneously with sensitive biological information. Once away from main body, fingerprint as identification symbols has become personally identifiable characteristics, becoming a personal message which called fingerprint information. Identity card law of the peoples Republic of China citizen residents (hereinafter referred to as the new Resident Identity Card Law) amended in 2011, stipulates the third, when the citizens apply for personal identity, they were asked to register personal fingerprint. The birth of this amendment leads many academic concerns, but also there are many objections. The peoples Republic of China entry and exit management method implemented in July 1, 2013(hereinafter referred to as the new Immigration Control Measures) refers, approved by the State Council, Ministry of Public Security, Ministry of Foreign Affairs of the Exit and Entry needed, we can retained human biological identical information such as the fingerprint. To some extent, the two laws passed means that Chinese government?s conduct of collecting national fingerprint information have be set down by way of legislation. Undoubtedly, it has great significance in safeguarding national security, maintaining social order and facilitating national management. However, conceptual basis of the fingerprint information collection, research and application of fingerprint information protection issues is still in its infancy.
