AbstractIn recent years, with the development of economy and the ever-increasing projects of engineering construction, the commercial bribery is rampant, which is a tense situation. Premier Wen Jiabao once pointed out in 2006 that special work of treatment of commercial bribery should be concentrated with the focus on such six fields as engineering construction, land transfer, property right transaction, purchase and sale of medicine, government purchase and resource development and distribution; that unfair transactions should be firmly corrected and cases of commercial bribery should be investigated in accordance with the law. And in the above six fields, engineering construction is the priority. Therefore, it is conducive to perfect the investigation countermeasures for such cases and establish and perfect a permanent mechanism for cracking down such kind of crimes through the study on the crime of commercial bribery in the field of engineering construction.On the basis of reference to a large number of excellent works and papers, the present paper is finished by adopting comparative, logical verification, historical as well as positive study approaches and adding the author’s own ideas. The present has three parts with about 33000 words.The first part is a summary of the crime of commercial bribery in the field of engineering construction. This part gives a brief introduction of the concept and legal characteristics of commercial bribery, analyzes the forms of commercial bribery in the engineering construction field and confirmation of such kind of crime, and introduces the current situation of commercial bribery in the field of engineering construction that commercial bribery has permeated every part of engineering construction especially in the phrase of bid and tender.
