欧洲一体化历史进程中的主权让渡问题 摘 要 主权可以让渡吗？从第二次世界大战后兴起欧洲一体化历史进 程来看，这一点毫无疑问。从二十世纪五十年代开始，欧洲一体化 的成员国们基于谋求欧洲和平、联合发展的目的，自愿将本国的部 分主权让渡给超国家的一体化机构。纵观欧洲一体化发展的历史， 这种主权的让渡从经济领域逐步扩大到内政、司法、外交、防务和 政治领域，可以说当今欧洲联盟中发生的主权让渡现象涉及到组织 机构、决策机制、法律制度等各个方面。 就欧洲一体化历史进程中出现的主权让渡问题来看，这种主权 让渡主要是受到全球化和区域一体化的影响，欧洲国家以平等、自 愿、互惠的方式将原本属于各国政府的权力让渡了出来，以超国家 机构的方式来共同分享主权，共同行使主权。 欧洲一体化历史进程在二十一世纪面临更严峻的挑战，这种挑 战来自内在体制面临改革的压力，以及外部的国际环境的影响。欧 盟正在制定和批准的宪法条约，将实现更多的主权让渡，也必将会 深刻的影响欧洲一体化的未来。 关键词：欧洲一体化； 进程； 主权让渡； 欧盟的未来 On the Transfer of Sovereignty in the Course of European Integration Abstract Can the sovereignty be transferable? It is no doubt when we investigate the European integration since the end of World War Ⅱ.From 1950, the member states of West Europe began to transfer their partial sovereignty to the supranational institutions voluntarily, the purpose is to keep peaceful co-existance in the post-war. When we make a comprehensive view about the course of European integraion, it is not hard to find that the certain sovereignty has already transferred from economic domain to the civil affairs, legal system, regional military defense and political domain. Therefor, sovereignty transfer marks its characteristic trace in EU’s organization, decision-making and legal system etc. The sovereignty transfer rooted in the influence of globalization and regional integraion. Hence member states transferred their government own power to the suprantional institutions, sharing the sovereignty and co-exerting the sovereignty equally, voluntarily and multual-beneficially.
