381.3 行政管理（Administration）　　§Administration. 　　(a)[Reserved] 　　(b)TheAdministratormayinspecificclassesofcaseswaiveforlimitedperiodsanyprovisionsoftheregulationsinordertopermitappropriateandnecessaryactionintheeventofapublichealthemergencyortopermitexperimentationsothatnewprocedures,equipment,andprocessingtechniquesmaybetestedtofacilitatedefiniteimprovements:Provided,ThatsuchwaiversoftheprovisionsoftheregulationsarenotinconflictwiththepurposesorprovisionsoftheAct. 　　(c)Pursuanttosection6oftheAct,theAdministratorbelievesthat,inestablishmentsprocessingpoultryproductsatwhichinspectionundertheActandregulationsisrequired,thefrequencywithwhichandthemannerinwhichpoultryproductsmadefrompoultrypreviouslyslaughteredandevisceratedinofficialestablishmentsarereinspectedbyInspectionServiceemployeesshouldbebasedonconsiderationsrelevanttoeffectiveregulationofpoultryproductsandprotectionofthehealthandwelfareofconsumers.Inordertotestproceduresforuseinmakingsuchdeterminationsand,inparticular,fordeterminingwhetherand,ifso,towhatextenttheintensityofinspectioncoverageexceedsthatwhichshouldbedeemednecessarypursuanttosection6oftheAct,theAdministratorisinitiatingexperimentationofanewsystemofinspectionforreviewingtheperformanceofestablishmentsandfordesigningthesupervisionandotherconditionsandmethodsofinspectioncoverage.Fortheperiodofsuchexperimentation,theAdministratorshallidentifyestablishmentsforreview,andthefrequencyandthemannerofinspectionbyInspectionServiceemployeesshallbedeterminedonthebasisoftheresultsofthosereviewsandbeotherwiseinaccordancewiththissection. 　　(d)Thedeterminationsreferredtoinparagraph(c)ofthissectionshallbemadebytheInspectionServiceandshallreflectevaluationsoftheperformanceandthecharacteristicsofsuchestablishments. 　　(1)Inassessingtheperformanceofanestablishment,thefollowingfactorsareappropriateforconsideration: 　　(i)Thehistoryofcompliancewithapplicableregulatoryrequirementsbythepersonoperatingsuchestablishmentorbyanyoneresponsiblyconnectedwiththebusinessoperatingsuche
