论劳动权 摘 要 劳动权是一项重要的宪法权利，对劳动权的保障是关系到社会和谐的大事。劳动权入宪经历了一个发展过程，休现了劳动权具有的自由权和社会权的双重属性。宪法劳动权的完善，必须以劳动权的这两层属性为基点，参照《经济、社会、文化权利国际公约》的规定完善其内容，激活劳动者的宪法权利，这对于处在社会转型期的中国具有特别重大的意义。 劳动是人类赖以生存发展的技能，劳动权的保障涉及到人的生存和发展，是重要的宪法权利。《劳动合同法》的颁布和实施是保障我国公民劳动权的一个标志性的事件，对于保障劳动权有看重要的意义。但是，类似于华为公司员工集体辞职案之类的企业试图规避法律的事件的发生则表明，劳动权的保障在我国仍是任重而道远。劳动权的保障关系到社会的和谐稳定，应当通过宪法保障劳动权的实现。 关键词　劳动权；自由权；社会权；宪法 The Theory of Labor Right Abstract Labor right is one of the most important constitutional rights, for the protection of labor rights is related to social harmony. Labor rights into the constitution has undergone a process of development, the dual attributes of sue now labor right has the freedom right and social right. Perfecting the labor rights of the constitution, must be based on the two layer of the attribute of the labor rights as the starting point, according to economic, social and cultural rights, the International Convention shall improve the content of active workers, constitutional rights, which has great significance for the period of social transformation in china. Labor is human survival and development skills, the protection of labor rights related to human survival and development, is the important constitutional right. Labor contract law the promulgation and the implementation is a landmark event to safeguard our country labour rights, for the protection of labor rights has an important significance. However, similar to the Huawei Company staff collective resignation case such enterprises tried to circumvent the law event indicates that, the protection of labor rights in China is still a long way to go. The protection of labor rights related to social harmony and stability, should protect labor rights by the constitution.
