和谐社会构建中的制度正义研究 摘 要 构建和谐社会是我国当前社会主义建设的重要任务和目标。社会公平正义是社会和谐的基本条件，而制度正义是社会公平正义的核心和根本保障。当前我国社会公平正义问题日益凸现，真正实现制度正义对解决社会公平正义问题与和谐社会建设具有重要意义。本文在理论上从哲学、伦理学、政治学、社会学、法学等多学科交叉的角度，以制度伦理学特别是制度正义的相关理论为分析工具，并立足于我国社会转型与制度变迁这一特定历史背景，论述了制度正义对构建和谐社会的重要意义，剖析了我国制度正义问题凸现的原因，进而探求实现制度正义的对策和途径。 第一部分制度正义的理论演进及基本内涵。制度正义理论起源于古希腊，最早由柏拉图提及，并被亚里士多德继承和发展。17、18世纪欧洲启蒙运动，尤其是社会契约伦的诞生有力地推动了制度正义理论的发展。到了19世纪，随着功利主义在西方开始大行其道，制度正义理论也不可避免地带有功利主义的色彩。在20世纪，美国人约翰·罗尔斯则摒弃功利主义，重新在社会契约论的基础上阐释和证明了构成社会制度之首要美德的正义理论，标志着现代意义上的制度正义理论形成。制度正义是人们对应当建立什么样的制度与制度应该如何发挥其作用的道德关注和伦理思考，包含制度本身的正义和制度运行的正义两个方面。 第二部分制度正义与和谐社会。就一般理论而言，制度正义的社会价值体现在四个方面：制度正义是社会正义的核心和根本，制度正义的作用在于它能够建立公平与效率的平衡机制，追求权利与义务的公正分配是制度正义的主题，实现社会和谐与健康发展是制度正义的目标。具体到我国构建社会主义和谐社会而言，制度正义的意义主要体现在：它是我国和谐社会的本质要求，是维持和谐社会正常秩序的基本条件，为和谐社会奠定重要的物质基础、政治保障和制度保证。传统功利主义义利观的自由与利益的冲突法从应然到实然的流产弱势群体利益 Abstract Building a harmonious society of socialism in our country are an important construction mission and objectives.
