Post Doctor Research Fellow, The University of British Columbia(Canada). Abstract The amendment of Taiwan Trade Secret Act has not been implemented for economic espionage crimes and new types of technologies. this paper indicates the suggestion for legislation after analysis of United States laws and Taiwan status quo. The purpose of the trade secret protection is to maintain industrial ethics and order in competition, encourage the invention and innovation of technologies. Taiwan has regarded the trade secret as a part of the intellectual property. The TRIP Agreement has a great influence on the Taiwan legislation, and other foreign precedents are also taken as the important reference for the Taiwan legislation. This article will specifically address the impact of modern technology on trade secret law. Part I will provide an overview of R.O.C. trade secret law; Part Ⅱ will introduce the United states trade secret laws; Part Ⅲ will discuss specific threats to trade secrets posed by ubiquitous use of computer technology in the commercial environment. Finally, the issue of this article tries to discuss the Law and intends to suggest the other new statutes to comprise the trade secret protection in R.O.C.. The solutions of risks being losing trade secrets will increase the welfare of society and nation.
