现行刑法减刑制度的研究 ［辛商要］减刑是刑罚执行过程屮一项刑事Wj法活动，是我国刑罚制度的重耍组成部分，也 是目前最常用的一项法律奖励措施，它充分体现了我W “惩罚与宽大相结合、惩罚与教育相 结合”的刑事政策。减刑制度在司法实践中的应用非常广泛，起到了鼓励罪犯积极改造的作 用。但我国现行的减刑制度在减刑的各方面规定和执行中暴谣出诸多问题与不足，如案件的 审理程序不透明、监督机制不健全等，不但不利于实现减刑的真正□的，同吋也极易导致司 法不公，亟待引起重视认真加以解决。本文从减刑的概念出发，介绍减刑的条件、程序和功 能，通过对我W现行减刑制度的问题剖析，提出完善减刑制度的见解和主张。 ［关键字］减刑制度 存在的问题 完善 Research On the Current Commutation System Of The Criminal Law [Abstract] The commutation is a criminal judicial activities In the implementation process of punishment, and it is an important part of penal system of China,but also it is the most the most common legal awards.lt plenarily reflect the penal policy of combination of punishment with Leniency and Combination of punishment and education,besides it is Important means to realize the objective of penalty.lt is widely used in the judicial practice and play a significant role on encouraging criminal to transform.But the current commutation system of China reveals many problem and defect In the implementation and various aspects of Regulations such as opaque of case proceedings and unsound of oversight mechanisms.
