社区矫正背景下的检察机关职能研究 ——以修正后的刑诉法为视角 柳洁 梁琪 蒙振强 （梧州学院 法律与公共管理系，广西 梧州 543002） （梧州市苍梧县人民检察院，广西 梧州 543002） 【摘要】自引入“社区矫正”这一概念以来，我国的社区矫正试点工作已开展了八年多，其中检察机关的监督职能起到了至关重要的作用，保障了社区矫正工作的顺利进行。修正后的刑诉法虽对社区矫正的执行主体、对象等进行了规制，但社区矫正的检察监督仍存在诸多“盲区”，从而导致：检察机关监督职能缺乏法定依据；监督对象不明；执法方式单一；检察机关各部门之间缺乏协调性等一系列问题。为此，有必要在现行社区矫正语境下，对我国检察机关的监督职能进行相关研究，探索完善社区矫正中检察机关监督职能的具体途径，以保障检察机关监督职能的实现，维护司法权威及社会公平正义。 【关键词】社区矫正 检察机关 监督职能 The research of the functions of Procuratorial organs under the background of community correction-----take the amended criminal procedural law as an angle of view Liu Jie (School of law and public administration, Wuzhou University , Wuzhou 543002 China） Abstract: Since the introduction of the concept of “community correction , the community correction work of our country has been carried out for more than eight years, in which the supervision of procuratorial organs played a crucial role, protecting the community correction work smoothly. The community correction executive body and object have been regulated by the amended criminal procedure law, but the procuratorial supervision of the community correction still exists a lot of “blind areas , which leads to a series of problems, such as: the supervisory function of Procuratorial organs lacks of legal basis; the supervision object is unknown; The mode of law enforcement monotone; the departments of Procuratorial organs lack of coordination. Therefore, it is necessary in the current context of community correction of China, to do some related research on the supervision functions of the procuratorial organ, exploring the way of perfecting the procuratorial organs’ supervision function in community correction, in order to guarantee the realization of procuratorial organs supervision function, maintain judicial authority and social fairness and justice.
