Our country’s No.193 article of new Criminal Law in 1997 stipulated the crime of swindling loan in explicit terms in order to defend state’s financial order and crack down on criminal activities of financial business issues. But since the crime of swindling loan is a new charge, it has many crucial issues in judicial practice and these issues cause many disputes and there are various opinions about them but have no any final conclusion. This thesis explores such aspects in a comparatively deep way which relating to the definition of crime of swindling loan, the essential elements of constituting crime, the bounds between this crime and other crimes and some hot issues which have disputes in academic circles and the author hopes it can put forward some practical suggestions for judicial practice and legislature improvement.
