第三讲国际结算票据1：汇票 一、为什么会有汇票 1、传递信息的作用， 由何人何时何地支付多少金额的货币给谁 WHO、WHEN、WHERE、WHAT、WHOM 以支付金钱为目的，也叫资金单据、、金融单据，还有支票、本票 在汇款、托收、信用证中都会得到应用。 注意： 有些情况下不需要使用汇票（本票、支票），而是通过其他方式来传递付款信息，如汇款中的电汇（T/T）和信汇（M/T） 二、汇票介绍 1、样式 结论： 我国票据法：汇票是出票人签发的，委托付款人在见票时或者在指定日期无条件支付确定金额给收款人或者持票人的票据。 A bill of exchange is an unconditional order in writing addressed by one person to another, signed by the person giving it, requiring the person to whom it is addressed to pay on demand or at a fixed or determinable future time a sum certain in money to or to the order of a specified person, or to bearer. 2、汇票内容P45 (1)“汇票”字样 bill of exchange ,bill ,draft (2)无条件支付一定金额的命令 pay to (3)付款人 drawee to (4)付款期限tenor (5)付款地点 6)收款人 payee pay to_____ (7)出票日期和地点 (8)出票人签字 issuer \ drawer 无条件支付命令 汇票是一项支付命令，而不是付款请求。必须用祈使句，不能用表示请求的虚拟句。例如： Pay to A Company or order the sum of five thousand pounds only.——有效汇票 I should be pleased if you pay to the order of B company the sum of five thousand pounds only.——无效汇票 判断下列表述是否有效 Pay to ABC company or order the sum of five thousand pounds only providing the goods supplied in compliance with contract Pay to ABC company or order the sum of five thousand pounds from our account No. 1 with you Would you please pay to ----- I am glad if you pay to ----- 收款人 payee 汇票上的“收款人”通常称为“抬头” 汇票的抬头有三种写法： (1)限制性抬头 (2)指示性抬头 (3)来人抬头 （1）限制性抬头 这类抬头的汇票不得转让他人，只有票面上的收款人才有权取得票款。例如： （1）pay to John Smith only； （2）pay to John Smith not transferable； （3）“Not Transferable”字样出现在汇票上。 （2）指示性抬头 这类抬头的汇票可通过背书或交付的方式转让。这种抬头在实务中较多见，例如： （1）pay to the order of A Co.； （2）pay to A Co. or order.； （3）pay to A Co.。其他地方无not transferable字样 （3）来人抬头 空白抬头，也称为来人抬头。该汇票不需要背书，持票人凭交付即可转让汇票的权利。例如：pay to bearer/holder。有时尽管有具体的名称，但只要有“bearer”出现，即为空白抬头。例如：pay to ABC Co. or bearer等于pay to bearer。这种汇票是认票不认人，因此在商业法规不完善、治安不好的地方要少用。 我国《票据法》和《日内瓦统一法》都禁止使用来人抬头汇票。英国《票据法》允许使用来人抬头汇票。 确定的金额(certain in money) (1)以确定的货币表示（a sum certain in money）。汇票的支付标的必须是金钱，其金额必须是可以确定的。任何选择的或者浮动的记载或未定的记载，都使汇票无效。例如： 金额必须确定，不能模棱两可 这些表示方法都错误。如“大约付100
