××××大学本科毕业论文 新《律师法》修改的亮点与完善 摘 要 摘 要 PAGE 1 摘 要 1996年《律师法》在规范律师执业行为、保障律师权利、维护当事人的合法权益、维护法制的实施等方面起了重大的作用。但随着政治、文化、社会建设的发展，它已不能满足不断发展的现实要求而突显弊端。同时，96年《律师法》规定的合作律师事务所制度、国家出资组建的律师事务所制度的规定已与现实产生了冲突，表现出其滞后的一面。在律师职业权利保障方面，阅卷权、会见权、调查取证权等规定的较少，在律师及律师事务所的监管问题上，司法行政部门及律师协会职权配置不够合理。 面对上述缺陷，着眼于我国法律服务业的进一步发展，司法部于2004年6月开始起草新《律师法》。新《律师法》的修订历时三年多，先后易稿二十多次。与2008年6月1日正式实施。其两大目标为：加强对律师的职业监管和加强律师职业权利的保障。 本文共包括以下五个部分： 一、对新《律师法》进行修订的背景； 二、新《律师法》修改的亮点； 三、新《律师法》修改中存在的问题与不足； 四、完善和切实贯彻新《律师法》的几点建议； 五、结语。 关键词：新《律师法》 律师执业行为 保障律师权利 律师事务所制度 律师职业权利保障 律师的职业监管 ABSTRACT ABSTRACT PAGE 16 PAGE 3 ABSTRACT 1996, lawyers in the normative acts of lawyers to protect the right to counsel, safeguard the legitimate rights and interests, and safeguard the implementation of the rule of law has played a significant role. But with the political, cultural, social development, it has been unable to meet the practical requirements of the continuous development and highlighted the drawbacks.At the same time, 96 years law the provisions of law firm co-operation system, to fund the establishment of National Law Firm of the system has produced a conflict with the reality, showing its lagging side.
